TERMS & CONDITIONS

 

  1. Information on how to enter and claim and the prizes and rewards form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

  3. Entries and claims are only open to Australian and New Zealand residents aged 18 years or over who visit Townsville Airport, QLD during the Promotional Period (defined below).

  5. This promotion opens on 08/08/24 and closes on 28/08/24 at 11:59pm AEST (“Promotional Period”).
  6.  

  7. Employees (and their immediate families) of the Promoter, Participating Stores (defined below) and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

  9. The ‘Participating Stores’ for this promotion are Townsville Store, The Brewery, Maggie's Cafe and Castle Hill Café located at Townsville Airport, QLD.

  11. There are two (2) components to this promotion: 
    1. Limited Offer Component (defined below); and 
    2. Major Draw Component (defined below).

  13. Upon entering into this promotion, individuals will have the choice to participate in either the Limited Offer Component or the Major Draw Component. For the avoidance of doubt, by choosing to participate in the Limited Offer Component, individuals will not receive an entry into the Major Draw (defined below), and by choosing to participate in the Major Draw Component, entrants will forfeit eligibility for the Limited Offer Component.

To be eligible to enter either the Major Draw Component or claim a reward in the Limited Offer Component, individuals must, in a single transaction, spend AUD$20 or more at any Participating Store during the Promotional Period (“Qualifying Transaction”). Once individuals have completed their Qualifying Transaction, they will then receive a unique entry card from the staff member at the Participating Store. In the event a Qualifying Transaction receipt or unique entry card is not automatically handed to them, it is the individual’s responsibility to request one.   17. To participate in their choice of Component, individuals must, during the Promotional Period, complete the following steps: 
    1. visit the URL link on the entry card via their mobile device and follow the prompts to the entry page;
    2. Select either option a) to receive a AUD$20 Digital Visa Gift Card (“Limited Offer Component”) or option b) to receive one (1) entry into the Major Draw (“Major Draw Component”) and input the requested details (including but not limited to their first name, last name, valid email address, mobile number, date of birth, the airline they are travelling with, a star review and postal address). If the individual chooses to participate in the Limited Offer Component, they will be requested to insert the unique code that can be located on their entry card. If the individual chooses to participate in the Major Draw Component, they must upload an image of their Qualifying Transaction receipt; and 
    3. submit the fully completed entry form. 
    4. Entrants and claimants, as applicable, will then receive an email from the Promoter confirming that their claim or entry has been submitted. Successful claimants of the Limited Offer Component will receive a second email from the Promoter with their Digital Visa Gift Card.The Limited Offer Component will be limited to the first two thousand (2,000) valid claims received. Once all two thousand (2,000) valid claims have been received, claims for the Limited Offer Component will close and any entrants from this point will only be able to choose the Major Draw Component.

  19. Multiple entries and/or claims permitted, subject to the following: (a) only one (1) entry into the Major Draw or one (1) claim in the Limited Offer Component permitted per Qualifying Transaction (regardless of the amount spent at a Participating Store in excess of $20 in that Qualifying Transaction); (b) only one (1) entry or one (1) claim permitted per person per day; (c) a maximum of five (5) entries or five (5) claims permitted per person; and (d) each entry or claim must be submitted separately and in accordance with entry requirements. For the avoidance of doubt, individuals can only participate in one (1) Component using a singular Qualifying Transaction and are not eligible to participate in both the Limited Offer Component and the Major Draw Component using the same Qualifying Transaction.

  21. Entrants and claimants must retain their original purchase receipt(s) for all entries or claims as proof of purchase. Failure to produce the proof of purchase for all entries or claims when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries or claims and forfeiture of any right to a prize or a reward. Purchase receipt(s) must clearly specify the product purchased, store of purchase and that the purchase was made during the Promotional Period but prior to entry.

  23. The Promoter reserves the right, at any time, to verify the validity of entries or claims and entrants or claimants (including an entrant’s or claimant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry or claim process or engaged in any unlawful or other improper conduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

  25. Incomplete or indecipherable claims or entries will be deemed invalid.

  27. If there is a dispute as to the identity of a claimant or entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the individual.

  29. The first two thousand (2,000) claimants in the Limited Offer Component will receive a AUD$20 Digital Visa Gift Card via email. The Digital Visa Gift Card is only redeemable at the Participating Stores located at Townsville Airport, QLD.
  30.  

  31. There will be one (1) draw conducted for all entries received in the Major Draw Component during the Promotional Period (“Major Draw”). The Major Draw will take place at iGo Direct Group Pty Ltd, 41 Stubbs St, Kensington VIC 3031 on 04/09/24 at 2:00pm AEST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winner/s of the Major Draw will be notified by phone and email within seven (7) days of the draw.

  33. The first valid entry drawn from the Major Draw will win one (1) x Luxury Escapes Gift Card valued at AUD$5,000 (“Major Prize”).

  35. The Promoter’s decision is final and no correspondence will be entered into. 
  36.  

  37. Any ancillary costs associated with redeeming the Digital Visa Gift Card and Major Prize are not included. Any unused balance of the Digital Visa Gift Card and Major Prize will not be awarded as cash. Redemption of the Digital Visa Gift Card and Major Prize  are subject to any terms and conditions of the issuer including those specified on the Digital Visa Gift Card and Major Prize. The Digital Visa Gift Card is valid until 11/09/24 and the Major Prize is valid for three (3) years from the date of issue (see https://luxuryescapes.com/au/giftcards-terms for terms and conditions).

  39. Subject to the unclaimed prize draw outlined in clause 25, if for any reason a successful claimant does not redeem a Digital Visa Gift Card within two (2) weeks of receiving the Digital Visa Gift Card pursuant to clause 9(d) or a Major Draw winner does not take the Major Prize by the time stipulated in the Luxury Escapes Gift Card terms and conditions, then the Major Prize or Digital Visa Gift Card will be forfeited.

  41. If the Major Prize or any Digital Visa Gift Card is unavailable, the Promoter, in its discretion, reserves the right to substitute the Major Prize or Digital Visa Gift Card with a prize or reward to the equal value and/or specification, subject to any written directions from a regulatory authority.

  43. Total prize pool value for the Major Prize Component is AUD$5,000.

  45. Total prize pool value for the Limited Offer Component is AUD$40,000.

  47. The Major Prize or Digital Visa Gift Cards, or any unused portion of the Major Prize or a Digital Visa Gift Card, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

  49. A second  draw for the Major Prize, if unclaimed, may take place at iGo Direct Group Pty Ltd 41 Stubbs St, Kensington VIC 3031 on 02/10/24 at 2:00pm AEST, subject to any directions from a regulatory authority. The winner, if any, will be notified by email and phone within seven (7) days of the draw

  51. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.

  53. Entrants and claimants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner or successful claimant (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

  55. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant or claimant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

  57. Any cost associated with accessing the promotional website is the entrant’s or claimant’s responsibility and is dependent on the Internet service provider used.

  59. The use of any automated software or any other mechanical or electronic means that allows an entrant or claimant to automatically enter or claim repeatedly is prohibited and will render all entries and claims submitted by that entrant or claimant invalid.

  61. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of or connected to the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner, entrant or any successful claimant; or (f) use of a prize or reward.

  65. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://assets.website-files.com/5b74bf05cf70820e5b1a40a3/655c6162046449a966c9e5cb_Privacy%20Policy%20Summary%20(website).pdf. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant or claimant. The Privacy Policy also contains information about how entrants or claimants may opt out, access, update or correct their PI, how entrants or claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.

  69. Should any issue arise in relation to these Terms and Conditions or the Promotion, the laws of Queensland shall apply.
